If you use this website, or register for an account via our sign-up page, you agree to accept our terms and conditions. If you do not accept these terms, please do not register for an account, or use or purchase any Noisy Classroom services.

  1. Definitions: Noisy Classroom Ltd (hereinafter, “Noisy Classroom,” “we,” “us,” or “our”) provides information, resources, events, videos, PDFs and courses (collectively, the “Services”). Individuals or organisations which access, purchase or use the Services in any way are referred to in this Agreement as “you”, “your” or “Customer”. “Website” refers to the entirety of noisyclassroom.com and oratoryfestival.com, including any other webpages or services owned by the Noisy Classroom and accessed via those websites. “Account” refers to your personal or organisation’s account at noisyclassroom.com and/or oratoryfestival.com.
  2. Account notifications: you agree that we can use the email associated with your account to provide you with essential updates regarding your account, subject to our privacy policy. You agree to verify this email when you sign up on our website, and to keep this email updated so that we can keep in contact with you.
  3. Free plans: Users of our “Free (newsletter subscriber only)” plans agree to subscribe to at least one of our newsletters. If, at any time, you cease subscribing to any of our newsletters (either by unsubscribing on our website, or via Mailchimp), you agree that you will cease to use any resources that you may have already downloaded using that plan, and that further access to any resources included in that plan will be rescinded.
  4. Age restrictions: Our site is primarily for the use of teachers. We may, at our discretion, restrict access to any user who we believe to be below the age of 18.
  5. Your obligations regarding your Account: By using this Website, or registering an Account, you agree that you will
    • provide accurate and current information about yourself, and about any school or organisation to which you belong and on whose behalf you may be using the site
    • maintain and update your account information when information about yourself (or organisations to which you belong and on whose behalf you may be using the site) changes
    • keep your Account secure by protecting your password and not allowing others to access your Account using your password (if you are part of a school which has paid for a plan, other staff can register for their own account)
    • notify the Noisy Classroom promptly if you become aware, or have any reason to suspect, that there are any security breaches or unauthorised access to your Account or the services which you use via your Account
    • assume responsibility for all activities (including, but not limited to, comments, posting and sharing of resources) that occur under your Account, and that you accept all the risks of anyone else accessing your Account.
  6. Fees: From time to time, the Customer may be required to pay fees (the “Fees”) as are determined by the Noisy Classroom. Fees are not refundable, except when this is expressly stated otherwise. If you fail to pay Fees, we may terminate or suspend your Account. Fees are given in UK pounds (£) and, except if indicated otherwise, do not include any taxes. You are responsible for paying any taxes that may be required in your locality, or any international transaction fees which may be incurred, and you agree to indemnify the Noisy Classroom for any such taxes or fees. Fees will be paid in advance of any subscription period, and may be charged automatically to a payment method which you provide. Should you wish to avoid automatic payments on any auto-renewing services, you should terminate these services prior to renewal. Noisy Classroom reservices the right to increase our Fees, and will provide you with reasonable notice of our intention to do so.
  7. Noisy Classroom owns the Services: all Services (including but not limited to all text, images, PDFs, videos, templates, code, audio, or designs) are solely and exclusively owned by or licensed to the Noisy Classroom.
  8. Customer’s Limited Rights: If you comply with this Agreement, the Noisy Classroom grants you a fully revocable limited, non-exclusive, non-sublicensable, non-transferable, right to access and use the Services for the sole purpose of furthering the education of yourself or your students. You shall not share, rent, lease, sell, distribute, license or transfer in any way or by any means any of the Services to third parties, except where authorised by the Noisy Classroom in writing. Upon termination of the Agreement or of your Account, you must immediately cease all use of the Services, and you shall have no further right to make any use of them and shall destroy all copies that may be in your possession, or in that of any unauthorised users within your organisation.
